Los magistrados estiman en parte los recursos y establecen que: a) por la constituci\u00f3n del pr\u00e9stamo, el pago incumbe al prestatario, de acuerdo a la jurisprudencia constante de la Sala III del propio Supremo; y b) por el timbre de los documentos notariales, el impuesto correspondiente a la matriz se abonar\u00e1 por partes iguales entre prestamista y prestatario, y el correspondiente a las copias, por quien las solicite.
